Legal framework: when is telephone acquisition prohibited?

First of all: telephone acquisition is prohibited in the B2C segment, i.e. towards end consumers. To be able to carry out this type of cold calling, you need the express permission of the person to be called.

If, on the other hand, you want to acquire a business customer via telephone acquisition, the law here is somewhat milder than the acquirer. According to the law against unfair competition, telephone acquisition is permitted from business customers if at least presumed consent could be given. So if you sell screws and dowels, for example, you can assume that a craft business might be interested in your offer. A presumed consent has been given and you can make phone calls.
